Terms of use

Effective from 15 Oct 2026

These terms apply to everyone who uses Cask Manager, whether you visit the website, sign in as a member of an organisation's team, or use the owner portal. By creating an account or using the service, you agree to them.

Cask Manager is provided by [Operator legal name] Ltd ("we", "us"), a company registered in Scotland with company number [Company number].

1. How these terms fit with your organisation’s agreement

Most people use Cask Manager because an organisation, such as a bonded warehouse, distillery or broker, has a subscription with us and has given them access. That organisation's written agreement with us sets out the commercial terms, including fees and any service levels. If it conflicts with these terms, the organisation's agreement takes priority.

2. Your account

When you have an account, you agree to:

  • give accurate details and keep them up to date;
  • keep your password and any security keys or authenticator codes to yourself;
  • use multi-factor authentication where your organisation requires it;
  • tell us, or your organisation’s administrator, straight away if you think someone else has used your account.

Accounts are personal. Do not share one between colleagues. Your organisation's administrators decide what you can see and do, and they can change or remove your access at any time. You are responsible for what is done through your account unless it was used without your permission and you were not at fault.

3. Acceptable use

You must not use Cask Manager to:

  • break the law, including excise, customs, anti-money laundering and data protection law;
  • record ownership, movements or stock you know to be false, or misrepresent who owns a cask;
  • access records, accounts or organisations you have not been authorised to reach;
  • upload malware, or interfere with the security or running of the service;
  • scrape, copy or resell the service or its content;
  • harass, threaten or abuse other people, or post content that is unlawful or infringes someone else’s rights.

We may remove content or suspend access that breaks these rules. Where we can, we will explain why and give you a chance to respond, and moderation decisions can be appealed from within the app.

4. Who owns the data

The records an organisation keeps on Cask Manager belong to that organisation. We do not claim ownership of them. The organisation gives us permission to store and process them only so we can provide the service, and we handle any personal information in them as its processor, as described in our privacy notice.

When an organisation's agreement ends, we will provide a copy of its data on request within a reasonable period. After that we delete it, unless the law requires us to keep it.

Ownership records on Cask Manager reflect what the warehousekeeper holds in its stock account. They are not a title register in their own right, and the service is not an investment, custody or advisory service.

5. Our software and content

The software, design, documentation and other material we provide are owned by us or our licensors. You may use them only to work with Cask Manager under these terms. Feedback and suggestions are always welcome, and we may use them to improve the service without owing you anything for them.

6. AI-assisted features

Where your organisation switches on an AI-assisted feature, its suggestions can be wrong. Check them before you rely on them, especially for anything submitted to HMRC or shared with a customer. A suggestion only changes your records once a person accepts it, and the person who accepts it remains responsible for the result.

7. Availability and changes to the service

We work to keep Cask Manager available and reliable. There will still be times when it is unavailable, for planned maintenance, an upgrade, or a fault outside our control. Where we can, we will give notice of planned work in advance.

We keep improving the service, so features may change. We will not remove a feature your organisation relies on without reasonable notice, unless we have to for legal or security reasons.

You remain responsible for meeting your own legal deadlines. That includes HMRC returns and notifications, even if the service is briefly unavailable.

8. Our liability

Nothing in these terms limits liability that cannot be limited by law. That includes liability for death or personal injury caused by negligence, and for fraud.

Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, business or goodwill. Where you use Cask Manager through an organisation, our total liability is as set out in that organisation's agreement with us. Where there is no such agreement, the service is provided as it stands and our total liability is limited to the amount, if any, you have paid us in the previous twelve months.

Cask Manager is a tool for keeping records. It does not replace your own professional judgement, or legal, tax or excise advice.

9. Suspending or closing an account

You can stop using Cask Manager at any time. Your organisation can close your account, and we may suspend or close it if you seriously or repeatedly break these terms, or if we must do so by law. Closing an account ends your access, but records your organisation is required to keep stay with that organisation.

10. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when the current version took effect. We will tell account holders about significant changes before they apply, and if you keep using the service after that, you accept the new terms.

11. Governing law

These terms are governed by the law of Scotland, and the Scottish courts have exclusive jurisdiction over any dispute arising from them. If you live elsewhere in the UK and use the service as a consumer, you may also bring proceedings in the courts of the part of the UK where you live.
